Yes, under the Work Injury Benefits Act (WIBA) of 2007, every employer in Kenya is legally mandated to carry WIBA insurance cover for their workers (including casuals and domestic staff). Failure to have a WIBA policy is a criminal offense punishable by heavy fines or imprisonment.

Public Liability covers claims for accidental bodily injury or physical damage to third parties occurring on your premises (e.g. a customer slips on a wet floor). Professional Indemnity covers financial losses that clients suffer due to your professional negligence, errors, omissions, or bad advice (e.g., an accountant making a tax filing error resulting in heavy penalties).

WIBA premiums are calculated as a percentage of the total annual gross earnings of your employees. Earnings include basic salaries, commissions, allowances, and bonuses. The rate varies depending on the risk class of the employee (e.g., office staff have a low rate like 0.1%, while factory workers or drivers have a higher rate like 1.5% - 3%). At the end of the policy year, an audit is done to adjust for changes in wage bills.
